General Terms and Conditions
Article 1 – Definitions
In these general terms and conditions, the following terms shall have the meanings set out below:

Withdrawal Period: the period during which the consumer may exercise their right of withdrawal.

Consumer: any natural person not acting in the course of a professional or commercial activity who enters into a distance contract with the merchant.

Day: a calendar day.

Ongoing Contract: a distance contract concerning a series of products and/or services, whose delivery and/or purchase obligation is spread over time.

Durable Medium: any instrument that enables the consumer or the merchant to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the information stored.

Right of Withdrawal: the consumer’s right to withdraw from the distance contract within the withdrawal period.

Merchant: the natural or legal person who offers products and/or services to consumers at a distance.

Distance Contract: a contract concluded under a system organized by the merchant for the distance sale of products and/or services, making exclusive use of one or more means of distance communication up to and including the conclusion of the contract.

Means of Distance Communication: any means that can be used for the conclusion of a contract without the consumer and the merchant being present in the same place at the same time.

Article 3 – Applicability
These general terms and conditions apply to every offer made by Norah Beau as well as to every distance contract concluded between Norah Beau and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, the consumer will be informed of where the terms can be accessed, and they will be sent free of charge upon request.
If the contract is concluded electronically, these terms may also be provided electronically in a way that allows the consumer to easily store them on a durable medium.
In case additional product- or service-specific conditions apply, the provisions of these general terms and conditions also apply. In the event of conflicting terms, the consumer may rely on the most favorable provision.
If one or more provisions of these terms are void or annulled, the remaining provisions remain fully applicable. The invalid provision shall be replaced by one as close as possible to the original intent.
Situations not covered by these terms and any uncertainties regarding their interpretation shall be assessed in the spirit of these terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
Offers are non-binding. Norah Beau reserves the right to modify or adapt offers.
The offer includes a complete and accurate description of the products and/or services offered. Images used are intended to represent the products faithfully, but variations in color due to screens or lighting may occur.
Obvious mistakes or errors in an offer do not bind the merchant.
Each offer contains information enabling the consumer to clearly understand their rights and obligations if accepted, including:

The total price (excluding customs duties and import VAT, which are borne by the consumer).

Shipping costs, if applicable.

The method of contract conclusion and necessary steps.

The applicability of the right of withdrawal.

Payment, delivery, and performance details.

Article 5 – Contract Conclusion
The contract is concluded at the moment the consumer accepts the offer and fulfills all required conditions.
When an order is placed online, Norah Beau will confirm receipt of the acceptance electronically. Until such confirmation is received, the consumer may revoke the order.
If the contract cannot be executed due to errors in provided data, the consumer will be notified promptly and refunded if applicable.
Article 6 – Right of Withdrawal
6.1 Withdrawal Period
The consumer may withdraw from the contract within 14 days without reason or penalty.
The period begins the day the consumer, or a third party other than the carrier, physically receives the goods.
For multiple goods ordered together but delivered separately, the period starts from the day the final item is received.
6.2 Exercising the Right
To exercise the right, the consumer must notify Norah Beau of their decision clearly (e.g., by letter or email). A standard withdrawal form may be used but is not required.
6.3 Consequences of Withdrawal
If the consumer withdraws, Norah Beau will reimburse all payments received, including standard delivery costs (excluding additional costs for premium delivery options), without undue delay and no later than 14 days after notification of withdrawal.
Refunds are made using the same payment method, unless agreed otherwise. No fees will be charged for refunds.
The refund may be withheld until the goods are returned or proof of return is provided.
The consumer must return goods within 14 days of withdrawal notification. Return shipping costs are the responsibility of the consumer.
The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
6.4 Exclusions
The right of withdrawal does not apply to contracts involving:

Goods made to consumer specifications or clearly personalized.

Goods liable to deteriorate or expire quickly.

Sealed goods unfit for return for health or hygiene reasons if unsealed after delivery.

Goods which are inseparably mixed with other items after delivery.

Alcoholic beverages delivered more than 30 days after the contract, subject to market fluctuations outside the merchant’s control.

Digital content not supplied on a tangible medium if execution has begun with the consumer’s prior express consent and waiver of withdrawal rights.
Article 7 – Prices
Prices are indicated in U.S. dollars, inclusive of applicable taxes unless stated otherwise.
Norah Beau reserves the right to change prices at any time. Orders are charged based on prices valid at the time of purchase, unless there is a manifest error.
Shipping costs are not included unless explicitly stated.
Article 8 – Payment
Payment must be made using the methods available on the website.
Orders must be paid in full before shipment, unless otherwise agreed.
Article 9 – Delivery
Products will be delivered to the address provided by the consumer.
Delivery times stated are estimates. In case of delay, the consumer will be informed promptly.
If delivery is significantly delayed, the consumer may cancel the order free of charge.
Article 10 – Conformity and Warranty
Norah Beau guarantees that products comply with the contract, specifications, and applicable legal requirements.
Consumers must report defects promptly. Warranty rights remain unaffected by these terms.
Article 11 – Complaints
Complaints regarding delivered products or services must be submitted within a reasonable time after discovery.
Norah Beau commits to handling complaints as quickly as possible.
Article 12 – Data Protection
Personal data provided by the consumer will be processed in accordance with applicable data protection laws.
Data will only be used for order processing and customer relationship management.
Article 13 – Liability
Norah Beau is only liable for damages resulting from intent or gross negligence.
For minor negligence, liability is limited to foreseeable and typical damages.
Indirect damages such as lost profits or data loss are excluded.
Article 14 – Force Majeure
Norah Beau is not liable in cases of force majeure beyond its control, including but not limited to natural disasters, armed conflicts, strikes, epidemics, government restrictions, or major technical failures.
During force majeure, obligations are suspended for the duration of the event.
Article 15 – Amendments
Norah Beau reserves the right to amend these terms at any time.
Amendments will be communicated at least 30 days before taking effect.
If the consumer does not agree, they may terminate the contract in accordance with applicable rules.
Article 16 – Governing Law and Jurisdiction
These terms are governed by U.S. law.
In case of disputes, parties will attempt an amicable resolution.
If no resolution is reached, disputes shall be submitted to the competent courts of the state where Norah Beau is registered.
